CONDITIONS OF USE
- 1. These Conditions of Use govern your use of the Agency for Integrated Care’s (“AIC”)
Integrated Referral Management System (“IRMS”).
- 2. In these Conditions of Use, “you” and “your” refers to any person and/or organisation
who are users of the IRMS.
- 3. These Conditions of Use can be revised at any time without notice to you. Any
changes to these Conditions of Use shall take effect immediately and your continued
use of the IRMS will be deemed to constitute acceptance of the revised Conditions
of Use. It is your responsibility to check the website for such changes
from time to time. If you do not agree with these Conditions of Use, please do not
access or use the IRMS.
- 4. Any information or features that form part of the IRMS can be modified or discontinued
at any time, without notice to you and without liability.
USER ACCOUNT REGISTRATION
- 5. In registering for a user account, you represent and warrant that:
- 5.1. all registration details provided by you is true, accurate, current and complete
to the best of your knowledge and belief; and
- 5.2. you will promptly update AIC of any change to your registration details.
- 6. You must keep your user account ID and password confidential and shall allow
no other person or entity to use the user account. You must notify us immediately
if you have any reason to believe that the security of your user account has been
compromised.
- 7. You acknowledge and agree that AIC and its employees, officers, directors, affiliates,
partners, associates, agents and subcontractors may access your user account and
its contents as necessary for purposes including but not limited to identifying
or resolving technical problems or responding to complaints without prior notice
to you.
- 8. AIC reserves the right to reject your application for a user account or deny
you access to the IRMS without giving any reason.
YOUR USE OF THE IRMS
- 9. You agree to be responsible for all matters arising from your use of the IRMS
and for any and all activities which occur under your user account. For the avoidance
of doubt, in cases where you have allowed any other person to use your user account
or have negligently or otherwise made your password publicly available, you recognise
that you are fully responsible for:
- 9.1. the conduct of such user(s);
- 9.2. controlling the user’s access to and use of the IRMS; and
- 9.3. the consequences of any use or misuse of the IRMS.
- 10. You shall not to use the IRMS in any manner which breaches any applicable law
or regulation or which may cause an infringement of any third party rights;
- 11. You shall not to post, transmit or disseminate any information on or via the
IRMS which may be harmful, defamatory, illegal or create liability on AIC’s part;
- 12. You shall not to obtain or attempt to obtain unauthorized access, via whatever
means, to any other user’s account or to any other information within the IRMS which
are not intended for you.
- 13. The information contained within or generated from the IRMS is strictly confidential.
You may not reproduce, republish, upload, post, transmit, or distribute in any way
any material from the IRMS without the prior written permission of AIC.
PERSONAL DATA PROTECTION
- 14. You shall:
- 14.1 comply with all of your obligations under the Personal Data Protection Act
2012 (“PDPA”) and/or any other applicable law relating to data privacy or confidentiality;
- 14.2 provide all information and co-operation regarding the processing, use and
disclosure of a patient’s personal data which you had obtained through the IRMS
which AIC may reasonably require in order to comply with AIC’s obligations under
the PDPA;
- 14.3 only process, disclose or use the personal data obtained through the IRMS strictly
in accordance with and to the extent required for the purposes for which the personal
data was made available to you; and
- 14.4 keep private and confidential, and not disclose personal data obtained through
the IRMS to any third party unless authorised by AIC in writing or unless consent
has been sought from the person to whom the data relates.
- 15. If you upload personal data onto the IRMS, you warrant that you have obtained
the necessary consents from the person concerned for AIC and its service providers
to use and/or disclose the personal data for purposes contemplated by the IRMS,
including but not limited to:
- 15.1. AIC making a referral for patient to an appropriate service provider;
- 15.2. the service provider providing necessary services to care for the patient;
- 15.3. the service providers applying for subsidies on behalf of the patient;
- 15.4. calculation of the subsidy amount;
- 15.5. carrying out research, planning and statistical analysis; and
- 15.6. any other reasonable purposes related to the aforesaid.
- 16. You warrant that any personal data you upload to the IRMS is accurate and complete.
If you have obtained or received any personal data through the IRMS, you shall put
in place adequate measures to ensure that the personal data is accurate and complete.
You shall take steps to correct such personal data in your control or possession,
as soon as practicable upon receiving a request for correction from AIC or the person
to whom the data relates. If you receive information that personal data in the IRMS
is inaccurate, you shall also take such steps as are necessary to update and correct
the data residing in the IRMS by following procedures within the IRMS or as directed
by AIC.
- 17. If you have obtained or received personal data through the IRMS, you shall take
appropriate security arrangements to prevent unauthorised or accidental access,
collection, use, disclosure, copying, modification, disposal or destruction (or
other similar risks) of the personal data in your control and possession.
- 18. You agree to use and process personal data obtained through the IRMS only in
Singapore and not to transfer the personal data outside Singapore.
- 19. You shall delete from your records and/or destroy a patient’s personal data
obtained from the IRMS, and not keep any copies of the personal data in any form
when:
- 19.1. the referral application is withdrawn by the patient or the patient’s legal
representative;
- 19.2. you reject the patient’s referral application; or
- 19.3. there are no legitimate legal or business purposes for retaining the patient’s
personal data.
GENERAL DISCLAIMERS
- 20. You agree to use and access the IRMS at your own risk. AIC does not represent
or warrant that your use of the IRMS will be uninterrupted or free from error or
that the IRMS will be free from viruses or other harmful components and AIC disclaim
all liabilities in relation thereto.
- 21. You acknowledge that you have not relied upon any representation, warranty or
other assurance and you waive all remedies which, but for this clause, might otherwise
be available to you in respect of such representation, warranty or other assurance.
- 22. To the maximum extent permitted by the law, you agree that AIC and its officers,
directors, shareholders, employees, agents and sub-contractors shall not be liable,
in any circumstances whatsoever, for any loss of data, business, profits or goodwill,
loss of use, interruption of business, or for any indirect, special, incidental
or consequential damages of any character, even if AIC is aware of the risk of such
damages, arising from or in connection with:

- 22.1. your access, use or inability to access the IRMS;
- 22.2. any system, server, communication or connection failure;
- 22.3. any delays in operation or transmission;
- 22.4. the conduct of any person who accesses or uses or uploads any information
in the IRMS;
- 22.5. any computer virus; and/or
- 22.6. any omissions, inaccuracies, interruptions, defects or other problems with
the IRMS.
- 23. AIC’s liability to you in all cases relating to your use of the IRMS shall not,
for any reason, exceed Singapore Dollars 1,000. This limitation applies to all causes
of action in the aggregate including, without limitation, breach of contract, breach
of warranty, negligence, strict liability, misrepresentations and other torts.
- 24. You agree to indemnify AIC, its affiliated and related entities, and each of
their respective officers, directors, shareholders, employees, agents and sub-contractors
(collectively known as the “Indemnitees”) against all or any losses, claims, damages,
statutory penalties, actions, proceedings, costs, claims, demands, liabilities (whether
criminal or civil), settlements, expenses (including legal costs on an indemnity
basis) which may be suffered or incurred by the Indemnitiess or asserted against
the Indemnitees by any person, party, entity whatsoever, in respect of:
- 24.1. your unauthorised use of and access to the IRMS;
- 24.2. your breach of these Conditions of Use; and.
- 24.3. the occurrence of any event due to your act, omission or default which comprises
the security or integrity of the information in the IRMS, including but not limited
to patients’ personal data.

TERMINATION OF USE
- 25. AIC reserves the right to terminate your user account immediately without prior
notice, without giving you a reason and/or without further references to you if:
- 25.1. AIC (in its sole discretion) believes that you are in breach, or will be in
breach, of any of these Conditions of Use;
- 25.2. your user account is inactive;
- 25.3. AIC deems fit to do so for security reasons or to protect AIC’s interests
or the interests of other users of the IRMS;
- 25.4. AIC discontinues the IRMS; and/or
- 25.5. AIC is ordered by law enforcement or any governmental agencies to do so.
- 26. You shall notify AIC immediately when a person issued with a user account is
no longer in your employment or no longer needs the user account, so that AIC may
terminate the user account.
- 27. After termination, AIC may delete from the servers, any and all information
contained in your user account.
GOVERNING LAW AND DISPUTE RESOLUTION
- 28. These Conditions of Use shall be governed by the laws of the Republic of Singapore.
- 29. You agree to submit to the jurisdiction of the courts of the Republic of Singapore
and any dispute shall be referred to and finally settled by the courts of the Republic
of Singapore.
